So today after being tailgated..then cut off.. i proceeded to return the favour and was able to get infront of him.  Then at the next light he pulls beside me and starts swearing .. with his camera phone out the window..telling me he has my plate and the whole incident of him honking and me cutting him off on the camphone.   Says he will report me and take me to court,  to hike my insurance, because i cut him off on purpose . //.  Finding this pretty funny, I smile and say sorry .. it was not intentional .. then he continues swearing and speeds off
.. so what do you think ? am i a criminal ?  does he have a chance ?

I think if he's driving while taking pics on a camera phone, he'd be the one deemed to be driving in a less than professional way...
don't worry, every 2nd driver out there is a nob!

You're guilty of reckless endangerment. By your own words, you 'returned the favour' and tailgated the driver and then cut him off. Whether he did this to you first or not has nothing to do with the equation ... you are guilty of reckless endangerment. Stop driving like an asshole before you kill somebody.

So mixed thoughts then ..
Mr. Homo .. i was not tailgaiting him .. we were stopped at a red and i signaled and switched infront of him as the light turned green.
Either way .. if he wants me charged he has to show up in court and swear that he took the video .. etc.

This is similar to a minor fender bender I had in the past.  I was eating grapes and somehow rear-ended some guy but he was talking on his phone when it happened.  It wasn't really anything just a few scratches on the bumpers but I was worried he'd go to ICBC but he didn't.  Probably because he was talking on his cellphone and ICBC would find him at fault as well.  Whew...

what ever happened to focusing on the task at hand?  DRIVING.  When you're behind the whell your soul purpose is to operate your vehicle in a safe manner... It is NOT a time to put your make up on, eat your grapes drink your coffee and make your phone calls.  It is your duty to focus on your driving, not your other meaningless tasks that can be accomplished in the safety of your home or office.  Its no wonder my ICBC rates are so high!

Gregg, if either one of you bonehead drivers took this to court the judge would dismiss the case as frivilous and then give both of you a stern lecture about acting like morons behind the wheel.
